Pool fencing and compliance in the Sutherland Shire

Updated October 2026

In NSW you cannot lawfully sell or lease a property with a swimming pool without the right paperwork, and the paperwork depends on the fence. Shire Pool Renovations connects you with experienced, insured local contractors who handle pool compliance Sutherland Shire wide: fixing the barrier defects that commonly fail inspections, before the council or a registered certifier inspects.

A plain statement up front: in NSW, residential pool building and renovation work over $5,000 (incl GST), including barrier construction, must be done by an appropriately licensed contractor, and any electrical work by a licensed electrician. Certification itself is done by Sutherland Shire Council or a registered certifier, not by this site or the trades we refer. What the renovators we work with do is repair the barrier defects the inspector is likely to check. Whether it passes is the certifier's call.

The NSW rules in brief

These rules change from time to time, so confirm the current requirements with NSW Fair Trading, the NSW Swimming Pool Register or Sutherland Shire Council before you act on them. We state them as a guide, not legal advice.

Why pools fail inspection

Inspectors across the Shire fail pools for a familiar list, and almost all of it is fixable in a day or two of trade work:

Older Shire properties have a particular pattern: a pool fenced to the standard of its day, often decades ago, that has never been reassessed since. The standard moved, the garden grew, and the fence quietly stopped complying.

What compliance work costs

Guide pricing only. Small fixes, such as a new gate hinge and latch set, signage and gap adjustments, are often a few hundred dollars. Replacing a run of fencing typically runs into the low thousands depending on length and material, with frameless glass at the top of the range. Council inspection fees are capped under NSW rules, while private certifier fees vary, so ask when booking. You get a fixed quote for the trade work before anything starts. See the cost guide for where compliance sits in a full renovation budget.

Selling or leasing: the honest sequencing

If a sale is coming, deal with the pool barrier early, not in the week the agent lists. An inspection, any repairs, and a reinspection can take a few weeks end to end, and listings move faster than certifiers. If you are leasing, there is no non-compliance shortcut: a landlord needs a current certificate of compliance or relevant occupation certificate before a new lease. And if you are renovating anyway, fold the compliance work into the job: a pool that has just been resurfaced and retiled still needs its barrier dealt with before a sale or lease can go smoothly.

Frequently asked questions

Who issues the compliance certificate?

Sutherland Shire Council or a registered private certifier inspects the barrier and issues the certificate. The contractors we refer do the repair work on barrier defects before the inspection.

How long does a compliance certificate last?

Three years from the date of issue, under the current rules. If yours was issued more than three years ago, a new inspection is needed before a sale or new lease.

Can I sell with a non-compliant pool?

NSW allows a sale with a certificate of non-compliance, shifting the obligation to the buyer, though it can affect the price. A new lease, by contrast, generally requires a current certificate of compliance or relevant occupation certificate. Confirm the current rules with NSW Fair Trading before relying on either path.

Is my spa covered by the same rules?

Yes, spas capable of holding more than 300mm of water fall under the same registration and barrier requirements, with some allowances for lockable child-safe covers. Check the register's guidance for spa specifics.
